Holly Cade Photography - Terms and Conditions
Please note: contract specifics may change due to the nature of your requested event
1. A Summary of the Contract
The photographer is responsible for providing for the client a photographic service and products as detailed in section 2 (‘coverage’). The client undertakes to engage the photographer for this coverage for the price as detailed in section 3 (‘Payment Arrangements’).
2. The Coverage
Coverage will be provided by the photographer as follows:

The photographer cannot be held responsible for the lack of coverage caused by members shoot not being ready on time, nor by restrictions placed on the external venue if applicable. The photographer does not guarantee any specific picture nor to include any specific background, location, props, or arrangement, although every effort will be made to interpret the client’s wishes. The client agrees to accept the technical results of their imposition on the photographer. The photographer will offer technical recommendations only.
3. Payment Arrangements
The client will pay the photographer a total fee of £X subject to the following terms: A 15% non-refundable booking fee to secure the date and payable on execution of this agreement (to be agreed on booking). This booking fee is non-refundable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Payment for the remaining balance for all wedding bookings must be paid 4 weeks before the wedding at the absolute latest. A wedding cancellation less than 4 weeks before the date of a wedding shoot will require payment in full. All cancellations must be in writing. For smaller shoots (such as portrait or family sessions) payment must be made no later than the day before the shoot via bank transfer, and on the shoot itself in cash.
4. Copyright
Where a USB/online download of photographs has been provided to the client, these photographs may be printed and/or displayed online for personal use only, no commercial use. The photographer agrees not to sell the photographs for advertising or commercial usage. The photographer retains the entire copyright of the photographs at all times throughout the world. The photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of promoting her work and acquiring more work. However if the clients would prefer to not have their wedding photos shared online, or sharing them to be limited to a certain amount/certain photos, the photographer will accommodate for that, and these requests must be in writing.
5. Image Size, Colour, Style and Composition
All image sizes are approximate. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching if specified. It is sometimes not possible to record on film or in print the exact colour as seen by the human eye. There is no right to reject photos on the basis of style or composition.
6. Attendance
In the very unlikely event that the photographer is unable to complete the coverage due to unforeseen circumstances at her libel, the photographer will suggest another photographer to attend on her behalf to undertake the photography; the suggested photographer must be agreed with the clients.
7. Indemnity
The photographer agrees to indemnify the client against all expenses, damages, claims and legal costs arising out of any failure by the photographer to obtain any clearances for which she was responsible in respect of third party copyright works, trade marks, designs or other intellectual property. The photographer shall only be responsible for obtaining such clearances if this has been expressly agreed before the day of the shoot. In all other cases the client shall be responsible for obtaining such clearances and will indemnify the photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.
8. Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
9. Requested Photographs
The photographer will honour requests for specific photographs subject to the following: weather and time permitting; availability and the cooperation of the person(s) concerned. Weather and/or Delays Weather permitting, the photographs will be taken as agreed. In the event of inclement weather, the photographer in cooperation with the client, will make the necessary changes to the schedule and will do her best to produce coverage of the shoot specifics within the time allocated to her.

In the event of inclement weather, the photographer, in consultation with the client, will make the necessary changes to the schedule and will do her best to produce coverage of the wedding within the time allocated to her.
11. Abusive behaviour
The Photographer will not tolerate verbally or physically abusive behaviour. If the Client, or their official in charge, is unable to control the conduct of themselves or their guests towards the Photographer or the second photographer, resulting in an unacceptable degree of misconduct, or damages to the equipment caused by the guests, it will result in an early departure of the Photographer(s). The Client hereby acknowledges that in such an event, no refunds will be granted.
12. Concerning Covid19 & Pandemics
If the wedding needs to be rescheduled to a new date due to any legitimate incident relating to Covid-19, the photographer will do everything possible to accommodate the new proposed date. Please note this will be on a first come first served basis (as always). There will be no additional charges to reschedule the wedding to a new date (Unless the venue is a location that is not on the Isle of Wight, and normal minimal travel fees will apply), and the non-refundable booking fee will be transferred over to the new date. If the full amount has been paid and rescheduling takes place, the full amount will be carried over to the new date.
In the event that another wedding is already booked with the photographer on the new proposed date, the photographer cannot be held responsible for inconvenience. In this situation the non-refundable booking fee still stands. If any other payment has been made towards the full balance or the balance has been paid in full, that amount will be refunded.
The photographer will wholly abide by the current rules and regulations set by the government when photographing the wedding, which includes the use of facemasks, social distancing in both indoor and outdoor areas, hand washing and using hand sanitizer.
If it is deemed that Covid rules and regulations that have been laid out by the Government and the venue are not being adhered to (eg. The number of guests in attendance is too high) then, in order to protect the health of the photographer, her services may be withdrawn at any time. In this instance, a full fee will be charged.
